EU Slaps $495 Million Fine on 15 Car Makers for Recycling Cartel

On Tuesday, the European Commission imposed fines totaling approximately 458 million euros ($495 million) on 15 prominent car manufacturers and an industry association for their involvement in a cartel related to vehicle recycling programs.

BMW, Ford, Stellantis (the manufacturer of Jeep), and Volkswagen were involved in anti-competitive pacts aimed at avoiding payments to vehicle dismantlers and reducing consumer incentives to increase recycling efforts, according to the commission.

"We have firmly acted against businesses that conspired to stifle competition in recycling," stated Teresa Ribera, the EU's top antitrust official, in an announcement regarding the penalties.

Mercedes-Benz uncovered the cartel despite being involved in it. The company benefited from immunity, thus avoiding a €35 million fine due to their cooperation with regulators.

The European Automobile Manufacturers' Association (ACEA), which serves as an industry lobbying organization, functioned as a mediator according to the commission. They organized gatherings and connections among the automakers.

All firms acknowledged their role and consented to resolve the matter, it further stated.

According to EU regulations, vehicle owners should have the ability to return their obsolete or defective vehicles to dismantlers free of charge. In cases where this service incurs costs, the responsibility falls upon the manufacturers to cover them.

Automobile purchasers should likewise receive information regarding the "recycling efficiency" of newly purchased vehicles.

However, the firms involved — including Toyota, Suzuki, Volvo, Honda, Renault, Mitsubishi, and Opel — worked together to refrain from compensating dismantlers and exchanged confidential details about their separate arrangements.

They similarly concurred not to advertise the extent of vehicle recyclability, recoverability, and reusability, as well as the amount of recycled materials utilized in manufacturing new vehicles, as stated by the commission.

"These automobile makers collaborated for more than 15 years to evade charges for recycling services," stated Ribera.
